General Terms and Conditions

Summary

1. Scope

These General Terms and Conditions (GTC) apply to all deliveries made by Racelogic GmbH (hereinafter "Racelogic") to consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity.

3. Conclusion of the Contract

3.1 The presentation of products in the online shop does not constitute a legally binding offer, but merely an invitation to place an order.

3.2 By clicking the [Confirm Order] button, you place a binding order for the goods listed on the order page. The purchase contract is concluded when we accept your order by sending an order confirmation by email immediately after receipt of your order.

4. Right of Withdrawal

4.1 If you are a consumer (i.e. a natural person placing an order for purposes that cannot be attributed to your commercial or self-employed professional activity), you are entitled to a right of withdrawal in accordance with statutory provisions.

4.2 If, as a consumer, you exercise your right of withdrawal, you shall bear the direct costs of returning the goods.

4.3 In all other respects, the provisions set out below apply to the right of withdrawal.

Cancellation Policy

Right of Cancellation

You have the right to cancel this contract within fourteen (14) days without giving any reason.

The cancellation period expires fourteen days from the day on which you, or a third party designated by you (other than the carrier), took possession of the goods.

How to Start a Return

To ensure your return is processed efficiently and correctly, please use our online Returns Form:

Go to the Customer Service section in the footer of the store
Select "Returns" and complete the return form

Using the returns form ensures your request is logged correctly and processed as quickly as possible.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except any additional costs arising from your choice of a delivery method other than the cheapest standard delivery offered by us).

Reimbursement will be made without undue delay and no later than fourteen (14) days from the day on which we receive notification of your withdrawal. We may withhold reimbursement until we have received the goods back or until evidence of return has been provided.

Return of Goods

You must return or hand over the goods without undue delay and in any event no later than fourteen (14) days from the day on which you notify us of your withdrawal. The deadline is met if you dispatch the goods before the expiry of this period.

You are only liable for any loss in value of the goods if this loss is attributable to handling of the goods beyond what is necessary to establish their nature, characteristics and functioning.

5. Prices and Delivery Charges

5.1 Prices stated include VAT and other price components.

5.2 Delivery costs are charged separately and shown on the product pages, basket and checkout.

6. Delivery

6.1 Deliveries are made nationally and internationally via UPS; in exceptional cases via DHL or FedEx.

6.2 Delivery within Germany usually takes up to 3 days for items in stock. International delivery times may vary.

6.3 Please inspect goods upon delivery and report visible transport damage to the carrier and to admin@racelogic.de.

6.4 In case of force majeure or other uncontrollable events, delivery times may be extended or contracts withdrawn from with full refund.

7. Payment

7.1 Payment may be made in advance or by credit card.

7.2 Advance payments must be received before dispatch.

8. Retention of Title

Goods remain the property of Racelogic GmbH until full payment has been received.

9. Warranty and Repair Policy

Racelogic is liable for material defects in accordance with statutory provisions, particularly Sections 434 et seq. of the German Civil Code. All products include a minimum 2-year manufacturer's warranty covering defects in materials and workmanship under normal use, in accordance with the EU Sale of Goods Directive 2019/771.

10. Dispute Resolution

The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr.

We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board.

11. Liability

11.1 Racelogic shall be liable without limitation for damages resulting from injury to life, body or health, or in cases of intent or gross negligence.

11.2 In cases of slight negligence, Racelogic shall only be liable for breaches of essential contractual obligations. Liability shall be limited to the foreseeable, typical damage.

11.3 Racelogic products are intended as measurement, data logging and driver information systems only and do not replace driver judgement or vehicle safety systems.

11.4 The customer is responsible for ensuring correct installation, configuration, lawful use and compliance with safety requirements.

11.5 Racelogic is not liable for decisions made based on recorded data, signal inaccuracies, data loss or environmental interference.

11.6 To the extent permitted by law, Racelogic shall not be liable for indirect or consequential damages, including loss of profit or business.

11.7 Any further liability of Racelogic is excluded.

12. Governing Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Mandatory consumer protection provisions of the customer's country of residence remain unaffected.
